ESSAY TOPICS TO BE CHOSEN

 

  1. Describe the impact of the precedents  R v Dudley and Stephens ([1884] 14 QBD 273 DC) and Re A (conjoined twins) case ([2001] 2 WLR 480) on the substantive criminal law of England and Wales in the context of the admissibility of  necessity defense as a circumstance excluding criminal liability.
  2. Describe the concept of indirect intention as a form of mens rea in the criminal law of England and Wales (R v Woollin [1999] AC 82) and explain the difference between this concept and dolus eventualis- that is the form of intent as regulated by the Polish Penal Code. 
  3. Describe the difference between the two forms mens rea distinguished in the American and English criminal law: recklessness and negligence and provide an example of a case involving each of these.
